1. Acceptance of Terms
By accessing or using https://getifit.pro (the “Site”) or purchasing our IT services (the “Services”), you agree to be bound by these Terms & Conditions, our Privacy Policy, and Refund & Return Policy. If you do not agree, do not use the Site or purchase our Services.
2. Billing Terms
- One-Time Purchases: Full payment is due upon checkout unless a written payment plan is agreed upon. Invoices are sent via email and must be paid within 15 days of receipt.
- Subscription Purchases: Recurring payments are charged on the same date each billing cycle (monthly/annually) as selected during checkout. Subscriptions auto-renew unless canceled at least 3 business days before the next billing date.
- Late Payments: A 2% monthly late fee will be applied to unpaid balances after 15 days. We reserve the right to suspend Services for non-payment.
- Billing Description: Charges will appear on your statement as “getifit.pro – IT Services”.
3. Service Delivery
- We will deliver Services within the agreed timeline (outlined in your service agreement). Delays may occur due to unforeseen technical issues or missing information from your side (e.g., access credentials, project requirements).
- You agree to provide accurate and timely information to enable service delivery. We are not liable for delays caused by your failure to provide necessary details.
- Service modifications or additional requests will require a change order and may result in adjusted timelines and fees.
4. Intellectual Property
- Custom software, code, or configurations developed for you are licensed to your business for internal use. GETIFIT LLC retains ownership of any pre-existing tools, frameworks, or intellectual property used in delivering the Services.
- You may not reproduce, distribute, or resell any part of our Services without prior written permission.
5. Confidentiality
Both parties agree to keep confidential any sensitive information shared during the service engagement (e.g., business data, passwords, proprietary systems) for a period of 3 years after service completion.
6. Limitation of Liability
GETIFIT LLC shall not be liable for any indirect, incidental, or consequential damages (e.g., lost profits, data loss) arising from the use or inability to use our Services. Our total liability shall not exceed the amount paid for the specific Service in question.
7. Termination
Either party may terminate the service agreement with 30 days’ written notice. We may terminate immediately for breach of these Terms, non-payment, or illegal activity. Upon termination, you must cease using our Services and return any physical hardware or confidential materials.
8. Governing Law
These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of Los Angeles County, California.
